1. Reporting Intellectual Property Infringement

If you believe that your work has been copied in a way that constitutes copyright infringement or your intellectual property rights have been otherwise violated, please provide our Intellectual Property Agent with the following information:

  1. A physical or electronic signature of a person authorized to act on behalf of the owner of the intellectual property right that is allegedly infringed.
  2. A description of the copyrighted work or other intellectual property that you claim has been infringed.
  3. A description of where the material that you claim is infringing is located on the Site or App, with enough detail that we may find it.
  4. Your address, telephone number, and email address.
  5. A statement by you that you have a good faith belief that the disputed use is not authorized by the intellectual property owner, its agent, or the law.
  6. A statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the intellectual property owner or authorized to act on the owner's behalf.

  3. Notify the user who posted the material that it has been removed or disabled and provide them with a copy of your notice.

4. Counter-Notice by Accused Party

If you receive a notification from Shaqqi that your content has been removed or disabled due to a claim of infringement, you may provide a counter-notice to our Intellectual Property Agent, which must include:

  1. Your physical or electronic signature.
  2. Identification of the content that has been removed or to which access has been disabled and the location at which the content appeared before it was removed or disabled.

If a counter-notice is received by our Intellectual Property Agent, Shaqqi may, in its sole discretion, reinstate the removed content. Shaqqi will provide the original complaining party with a copy of the counter-notice. Unless the intellectual property owner files an action seeking a court order against the user, the removed content may be reinstated 10 to 14 business days after the counter-notice is received.

6. Repeat Infringers

Shaqqi reserves the right to terminate the accounts of users who are deemed repeat infringers. A repeat infringer is a user who has been notified of infringing activity more than twice and/or has had infringing content removed from the Services more than twice.

7. Misrepresentations

Any person who knowingly materially misrepresents that content or activity is infringing may be subject to liability for damages, including costs and attorneys' fees. If you are unsure whether the material in question infringes your intellectual property rights, please seek legal advice before submitting a notification.
